1. Introduction

These Terms and Conditions govern the supply of services by Prominent Kitchens and Joinery Pty Ltd (ABN 73 646 120 014) (“we,” “our,” “us”). By engaging us, you (“you,” “the client”) agree to be bound by these Terms and Conditions. They should be read together with any written quotation or contract we provide, which together form the agreement between us.

2. Our Services

We specialise in custom kitchen design, bespoke joinery, and commercial fit-out projects. All work is carried out in accordance with the scope detailed in the written quotation or contract agreed between you and us. Any variation to that scope must be agreed in writing and may affect the price and timeline.

3. Quotations and Pricing

Quotations are valid for 30 days from the date of issue unless stated otherwise. Each quotation sets out the cost of materials, labour, and any other expenses for the agreed scope of work. Prices may change where material costs increase, the project scope is modified, or you request additional work. We will notify you of any price change before proceeding, and any variation will be confirmed in writing.

4. Payments

A deposit of 10% of the quoted price is payable on acceptance of the quotation to confirm your booking. Progress payments are payable at the milestones set out in your contract, and the final balance is due on practical completion of the project. We accept payment by bank transfer, credit card, and Stripe. Work may be paused where a payment is overdue.

5. Cancellations and Refunds

Cancellations must be made in writing. If you cancel after work has commenced, you remain responsible for all costs reasonably incurred up to the date of cancellation, including materials ordered and labour performed. Deposits are non-refundable unless otherwise agreed in writing. Nothing in this clause limits your rights under the Australian Consumer Law.

6. Project Timelines

We will provide an estimated timeline for completing your project. While we make every effort to meet these estimates, timelines are indicative only and delays can occur due to circumstances beyond our control, including material supply, weather, site access, and third-party trades. We will keep you informed of any material change to the schedule.

7. Materials and Warranty

We use quality materials in all our projects. Materials carry the warranties offered by their respective manufacturers, and we will pass on the benefit of those warranties to you. We provide a 12-month workmanship warranty on our installation and joinery work. This warranty does not cover damage caused by misuse, neglect, normal wear and tear, or alterations carried out by others. Our warranties are in addition to any rights and remedies you have under the Australian Consumer Law.

8. Client Responsibilities

You agree to provide safe and timely access to the site and to supply any information we reasonably require to carry out the work. You are responsible for ensuring the site is ready for work to commence and for obtaining any permits, approvals, or consents required, unless we have agreed in writing to arrange these on your behalf.

9. Consumer Guarantees and Liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under that law.

To the extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from our services, and our total liability arising out of or in connection with the project is limited to the value of the contract between you and us.

10. Privacy

We respect your privacy and handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Information we collect is used to provide our services, to communicate with you, and for related administrative purposes.

11. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts of New South Wales.

12. Amendments

We may amend these Terms and Conditions at any time. Changes take effect once posted on our website or otherwise notified to you. The Terms in force at the time you accept a quotation will apply to that project.
